Chennai: V Gopalakrishnan, a resident of K K Nagar who filed an RTI application with the Chennai Corporation a year ago, got a reply from the civic body only a couple of weeks ago, and that too after the Tamil Nadu State Information Commission threatened to penalise its information officer. The civic body has replied to the queries of the applicant regarding government land in his area that was allegedly allotted to an individual in an unauthorised manner, but it has also asked him to pay Rs 600 to provide him the copies of documents he sought, even though the RTI Act stipulates that information should be provided free of cost if a department fails to provide it within 30 days of the receipt of application. In fact, the Act also says that the information officer, in case of failure to reply to the application within the time frame, is liable to a fine of Rs 250 for every day of delay, subject to a maximum of Rs 25,000. However, Gopalakrishnan had the last laugh on Saturday when he got a copy of the 300-page document free of cost, after the state information commission directed the Chennai Corporation to do so. Though the Central information commission and the state information commission have passed numerous orders making it clear that information officers were not entitled to ask for the cost of information if they fail to reply within 30 days, most of the departments fail to comply while many are not even aware of it. Only when they give information sought by applicants within the time frame can they can ask for extra costs such as photocopying (Rs 2 per page), Rs 50 for CD or floppy, and the actual cost of a sample or model if it is being provided to the applicant.

CHENNAI: Ten months after the Chennai corporation announced free burial and cremation facilities in the city complaints are piling up about burial
ground caretakers demanding bribe to carry out the final rituals in several parts of the city. N Nishore, a businessman, who had give Rs 1,500 as cremation "charges" demanded by the caretaker at Kodambakkam burial ground on Wednesday said that neither he nor his relatives knew that cremation charges had been waived by the corporation. "We were asked to pay Rs 1,000 immediately after the cremation and we had no time to argue. They charged an an additional Rs 500 the next day, when we went to collect the ashes," Nishore told TOI. Later, when he came to know about the corporation's announcement through his friends, he lodged a complaint with the corporation Commissioner Rajesh Lakhoni, demanding action against the caretaker. Meanwhile, in Annai Sathya Nagar near MGR Nagar, M Leeladevi, a resident, was asked to pay Rs 500 for the cremation of his day-old baby. It was only after complaints were made to the higher-ups that the local officials turned up and sorted out the issue. "It is highly unpardonable. All caretakers have a monthly salary, and have no right to demand money from the public. No concrete action is taken against these people even when complaints are preferred to the officials concerned," says V Gopalakrishnan, a social activist. Angry residents of Pammal Nallathambi Street in MGR Nagar forced a caretaker to repay Rs 700 he had collected from a family to carry out a cremation. " There are also many caretakers wandering in the grounds and it is difficult to identify the genuine staff, as noone wears the uniform supplied by the local body. T Arumugam, a CPI activist said. In july 2008, the local body regularised the services of 183 burial grounds caretakers in the city at a monthly salary of Rs 5,445. In November 2008, Mayor M Subramanian and his vigilance team had nabbed two burial ground caretakers in Moolakothalam, while demanding bribe from a family to carry out a cremation. Both of them were later suspended. When contacted, corporatiaon Commissioner Rajesh Lakhoni said that caretakers in Mylapore and Otteri were suspended following complaints recently. "We will take necessary action to ensure that such irregularities do not happen again. Our vigilance officials are taking necessary action in the field," Lakhoni added.

Probe against postmen for demanding ‘commission’

Chennai: The postal department, following a surprise check on Wednesday, has initiated disciplinary action against two postmen for ‘demanding commission’ from pensioners near K K Nagar. The postmen were disbursing Rs 400 to the beneficiaries.
Acting on a tip-off, the postal deparment deputed two assistant superintendents to conduct the check at Pulithevan Street in MGR Nagar. The postmen, delivering pension to at least 15 persons, had demanded Rs 20 from each.
Under the Indira Gandhi National old-age pension scheme, people above 65 years of age and those below the poverty line are eligible for a pension of Rs 200 from the Centre. The state government gives another Rs 200 to the eligible beneficiaries. This amount is delivered by postmen.
“We will take action against the offenders.The sum involved is low but the staff will face punishment as per conduct rules,” said a postal officer.
Postmen demanding and taking ‘commission’ from pensioners is common these days, said social activists. “They collect it openly. At times, near post offices,” said V Gopalakrishnan of FACT-India, a nongovernment organisation.
Pension to at least 18 lakh senior citizens, physically handicapped, widows, agricultural labourers, destitute/deserted wives, and unmarried, incapacitated poor women of 50 years and above is disbursed through special tahsildars in each district. “We have been receiving complaints about postmen. The department is considering electronic clearance system for pension disbursal,” social welfare minister P Geetha Jeevan told TOI.

Jeeva, TNN 1 July 2009, 03:21am IST CHENNAI: In a significant order, the Central Information Commission (CIC) has ruled that public authorities cannot demand cost of manpower andMadhav had filed an RTI application at the Southern Railway headquarters here on February 25, 2008, seeking details about different quotas available on train tickets, including information on quotas for agents, tatkal and emergency, and the number of tickets booked under each quota on the Pandian Express from January 10 to 20, 2008.
In its reply, Southern Railway said the applicant would have to pay Rs 750 to obtain the information since
the details sought were four months old. The railways further said that the existing reservation system was dynamic and that reservation records were available only for the last 5 days, which could be generated instantly. Hence, details pertaining to the earlier period had to be accessed from the main hard disc of the computer. Thus, the applicant needed to pay the amount, considering the use of different infrastructural devices such as hard disc, MIS application, CPU power, besides maintenance of equipment and eight man hours taken to compile the details, the railways told the applicant.
In his appeal before CIC, the applicant argued that the public authority was not entitled to ask the amount as it was beyond the purview of the Act.
After hearing the case, CIC in its order said: "The Commission agrees with the contention of the applicant that the RTI Act has no provision for charging any fees towards manpower and maintenance and accordingly directs the Southern Railway to provide the information, which has already been compiled by the respondents, free of cost.''
The Commission also "advised'' the applicant not to seek voluminous information that causes disproportionate diversion of the resources of the public authority.
CIC's order has evoked a welcome response among RTI activists. "It is a very good order as this sort of demand by public authorities will ultimately dilute the RTI Act. The Central government should communicate this order to all its departments forthwith,'' said V Gopalakrishnan, a resident of K K Nagar who has filed several applications under the RTI Act.

CHENNAI: As law enforcement agencies fail to keep a constant watch on public spaces meant for pedestrians and vehicle users, encroachers thrive
along arterial roads. And as corporation officials and the police force display little enthusiasm to restore public space to the city's citizens, anti-socials, backed by political clout, often take over. Regaining encroached land is not easy, as social activists will tell you.
Take the example of the three permanent sheds that suddenly cropped up last week on more than half a ground of land, off the Mambalam canal near Saravana Bhavan in KK Nagar. Until then, there was at the site a notice board put up by corporation authorities that suggested the land was owned by them. Today, the boards have been uprooted and can be seen near the canal, even as government officials move about in the area, ostensibly to provide various welfare measures'. "It is shocking," says K Pugazhenthi, an advocate who has complained to the local body about the encroachments.
On the road adjoining the canal there are more than 140 traders selling timber. The traders had earlier encroached on pavements near the ESI Hospital on Anna Main Road. It was only at the behest of the Tamil Nadu Housing Board that they were relocated to the present site. Instead of confining themselves to the earmarked space, they extended their outlets on to the road, shrinking further the narrow road space available.
"Traders have beeen pleading for a permanent site to be allocated by government. We have to wait and see whether the state regularises such encroachments," says V Gopalakrishnan, a social activist. Currently, the market rate for a small shop here is a whopping Rs 10 lakh.
On Anna Main Road, eateries have sprung along the roadside. Some have even built concrete structures near Metrowater's sewage treatment plant in Nesapakkam. Not a single corporation vehicle has come to demolish the structures, residents say. Hundreds of vehicles use the road to reach Virugambakkam and Porur, but that has not goaded authorities into initiating action against the offenders. Helping the eatery business thrive is a TASMAC outlet nearby.
The local body has also hardly shown interest in clearing encroachments on government-owned land in Soolaipallam, near the Adyar river. An Anganwadi (No. 784) has been running here for years, but now a portion of it has been encroached on by a neighbour. The remaining open space has been taken up by parked vehicles, huge garbage bins and construction material.
When contacted, concerned authorities said that they would soon initiate action and get rid of encroachments. "We have intimated the local police also," a senior official said.

Chennai: The State Information Commission (SIC) has imposed a penalty of Rs 25,000 on the public information officer (PIO) of the Tamil Nadu Electricity Board (TNEB) for not supplying information to a petitioner last week. This is the maximum penal amount which can be imposed under the Right to Information (RTI) Act.
R Natarajan, an RTI activist wanted to know the irregularties involved in billing a private firm located in North Chennai in 2007. However, the petitioner received the copy of the anti-power theft squad report alone, which recommended departmental action against seven officials who had failed to check periodical power consumption patterns of the firm.
Immediately thereafter, the petitioner made another application under RTI to the TNEB seeking information about the billing card. The PIO preferred to state that the billing card was not traceable and there was a chance of missing the card, as the case was 16 years old. The PIO also said that no official was to be blamed and recreating the file did not arise.
Aggrieved by this, Natarajan filed another application, wanting to know if any complaint was registered with the police, as the issue was deemed a criminal offence. When the public authority chose not to reply, the petitioner sought the commission’s help. Despite the latter’s intervention suggesting speedy disposal of the queries raised by the petititioner, the officer refused to give complete information. He also failed to oblige the commission’s directive to appear in person.
In it’s reply to the petitioner, the office of the PIO, TNEB stated that it had no obligation to answer questions as to “when, why and which,” which were not defined as information under RTI Act. During an inquiry by the commission last month, the TNEB’s public authority could not give a convincing reply as to why he absented himself during the previous summons.
Pointing out administrative lapses, the commission directed the TNEB to pay a compensation of Rs 500 to the petitioner for the instransigent non-supply of information. It also directed severe departmental action against the staff for violation of RTI Act, within a month.

Distributors Penalised For Selling Domestic LPG Cylinders To Commercial Establishments

Chennai: The Indian Oil Corporation has taken “stern action” against 25 distributors in the city for their alleged role in diverting domestic cylinders for commercial use during the last two years. The IOC, however, has not specified the nature of action. During repeated raids following complaints from the public, it was discovered that distributors themselves were involved in the business of selling domestic cylinders to commercial establishments at a higher price.
“Action has been taken against erring distributors and penalty imposed as per policy of the Indian Oil Corporation,” IOC deputy general manager G Ramkumar said in his reply to an RTI query, while confirming that diversions were made by authorised dealers of Indane between February 2007 and December 2008. The list of charges against distributors include diversion of domestic cylinders to non-existing customers, releasing unauthorised connections, collecting excess charges while supplying refills and behaving rudely with customers.
The distributors penalised for various malpractices include Kavitha Gas Agency, TUCS Limited (at Teynampet, Pallavaram, Shenoy Nagar, Villivakkam, Nungambakkam and Tiruvanmiyur), Barathi Gas, Nanda Gas, Naveen Gas Agency, Triloks Gas Agency, Sri Jayam Indane Gas, Sri Ma Kripa Gas Agency, Prarthana, South Madras Gas Agency, Super Flame, Rajesh Gas, Vaishnavi Agency, Padma Gas, Mahaganapathy and Trilok.
“The number of raids conducted by vigilance personnel of IOC is minimal. The department conducts raids only once in a month in most cases, even though diversion of cylinders for commercial purposes is so rampant these days,” said V Gopalakrishnan, an activist who had filed the RTI application.
Indane’s domestic cylinders of 14.2 kg each are supplied at a subsidised rate of Rs 314.75 per cylinder, while commercial cylinders of 19 kg are priced at Rs 830 in the market. “The cost difference enhances the chances of diversion of cylinders,” says D Johnson, a resident of Mylapore. Most of the tea shops in commercial areas such as N S C Bose Road in Broadway, Kodambakkam, K K Nagar, Mylapore and Ekkaduthangal are supplied with domestic cylinders. In the central business district, delivery boys of TUCS indulge in diversion of domestic cylinders in broad daylight, residents allege.
In its recent circular to all field level officials and LPG distributors, the office of the chief area manager said they should not insist on a 21-day waiting period before the customer books another cylinder. “But dealers are neither aware of such directions nor are they properly educated on customer relations. They turn down requests rudely despite being told about the circular,” M Leeladevi, a resident of Pammal Nallathambi Street, said.

School in a soup for taking fee sans receipt

Chennai: A government-aided school in K K Nagar came under the scanner of the education department on Tuesday after some of its officials demanded money for providing transfer certificates (TCs). After the intervention of the Department of Vigilance and Anti-Corruption (DV&AC), the district education officer conducted an inquiry.
The Kalaignar Karunanidhi Nirmala Girls Higher Secondary School on Kamarajar Salai is a government-aided institution till Class 10. Classes 11 and 12 are self-financed. On Tuesday morning, several parents and children who came to collect TCs were shocked when some teachers asked them to shell out Rs 200 as maintenance fee.
“They had collected Rs 5,800 as fees, including maintenance charges, at the beginning of the year. But they are again demanding money and that too without giving any receipt,” said Subramanian, a parent who refused to pay.
He said one of the teachers even claimed that the school’s clout extended to the chief minister’s office. “The school has been taking Rs 100 and Rs 200 during the year for various reasons. But the transfer certificate is necessary for the future of children and hence the parents give the money without questioning,” he said.
Another parent who gave the money said, “We did not want to have any problems and so we gave Rs 200.” Subramanian then informed his friend Gopalakrishnan, a member of Federation of Anti-Corruption Teams (FACT) India. The latter informed inspector Jeevanandham of the DVAC who alerted the district education officer.
Around 11.15am, the district education officer reached the school, conducted an inquiry and ordered the school to stop collecting money and also took an audit of the total money taken from parents.

Chennai: A government-aided school in K K Nagar came under the scanner of the education department on Tuesday after some of its officials demanded money for providing transfer certificates (TCs). After the intervention of the Department of Vigilance and Anti-Corruption (DV&AC), the district education officer conducted an inquiry.
The Kalaignar Karunanidhi Nirmala Girls Higher Secondary School on Kamarajar Salai is a government-aided institution till Class 10. Classes 11 and 12 are self-financed. On Tuesday morning, several parents and children who came to collect TCs were shocked when some teachers asked them to shell out Rs 200 as maintenance fee.
“They had collected Rs 5,800 as fees, including maintenance charges, at the beginning of the year. But they are again demanding money and that too without giving any receipt,” said Subramanian, a parent who refused to pay.
He said one of the teachers even claimed that the school’s clout extended to the chief minister’s office. “The school has been taking Rs 100 and Rs 200 during the year for various reasons. But the transfer certificate is necessary for the future of children and hence the parents give the money without questioning,” he said.
Another parent who gave the money said, “We did not want to have any problems and so we gave Rs 200.” Subramanian then informed his friend Gopalakrishnan, a member of Federation of Anti-Corruption Teams (FACT) India. The latter informed inspector Jeevanandham of the DVAC who alerted the district education officer.
Around 11.15am, the district education officer reached the school, conducted an inquiry and ordered the school to stop collecting money and also took an audit of the total money taken from parents.

Soon, a bullock cart carrying a tank halts near her. The cart driver fills his tank with water from the sintex tank, gives the woman Rs 30 and drives off.
The ‘trade,’ which has been going on in K K Nagar for the past several months has now spread to areas like Tondiarpet and Mylapore and even to commercial localities, including T Nagar.
The water in the sintex tank is supplied by the Chennai Metropolitan Water Supply and Sewerage Board (CMWSSB) or Metrowater to places where there is no proper piped water supply. There are 2,200 such tanks in the city; most of them located near slums.
“The water filled in tanks on bullock carts is supplied to hotels in various parts of the city,” said Gopalakrishnan of the Federation of Anti-Corruption Teams (FACT) India.
A bullock cartdrawn tank can carry 18 buckets of water and for each tank, the driver pays Rs 30 to the person who steals water from the sintex tank. The driver then sells the water to hotels and other commercial establishments for Rs 75 per tank.
“The water is filled in the tanks in accordance with the demand for the particular area. When the water is pilfered thus from tanks and sold outside, the residents are left with no water. As such, one family gets only two or three buckets a day,” said Mugilan of K K Nagar.
A senior Metrowater official, pointing out that such “sale” was illegal, said: “We have two teams to keep track of the supply and distribution of water. They have been issuing spot fines too. We will look into the issue and stop the supply of water till this pilferage is curtailed.”

Hundreds of motorists from Velachery, Pallikarnai and Medavakkam have a tough time navigating the stretch as several families have encroached the road. A broad estimate reveals that at least 300 families have made the roadside their home for more than a decade.
The families, initially about 50 of them, were brought by a contractor engaged by the Chennai Metrowater Supply and Sewerage Board to lay pipelines in Velachery.
“From 100 metres, they have encroached on more than a kilometre now. But the government is not interested in rehabilitating them,” said S Kumararaja, general secretary, Federation of Velachery Residents Welfare Association. Encroachments are not confined to the Taramani Link Road. There are squatter families on P T Rajan Salai and Kamarajar Salai in K K Nagar; 11th Avenue in Ashok Nagar; and Rattan Bazaar near N S K Bose Road in Parry’s. They vie for space with cabs at night. A spurt in the number of accidents involving pavement dwellers in recent months has only exposed the lackaidaiscal attitude of government machinery, said activist V Gopalakrishnanan. “In spite of our repeated attempts to evict them we couldn’t succeed as the hutment dwellers enjoy political backing,” a Chennai Corporation senior official said.

Consumers across the city complain about errant gas service company officials who do not deliver domestic gas cylinders on time but provide the same regularly to street-side shops. It is obvious that most fast food stalls and well-known sweet shops in T Nagar, K K Nagar and Park are using domestic gas cylinders.
It is easy for food stalls to avail of the gas cylinders, say the consumers. Mr V.Gopalakrishnan of MGR Nagar, said, “Most shops in our area use domestic gas cylinders. Shop-owners cleverly keep an empty commercial cylinder outside but use domestic gas inside the shop. Whenever we seek the service providers for refilling the cylinder, they do not respond immediately and the supply of the cylinders is delayed for no reason.” “While my service provider sometimes refuses to even record my order, claiming there is ‘no stock’, the roadside restaurants always have gas cylinders.
My cylinder is delayed by 20 days even when there is stock,” says Ms Stella George, a housewife from Kodambakkam.
Ms Dhanam of K.K. Nagar said, “The service providers don’t inform the waiting list number over phone, but provide cylinders to food stalls without fail.” On inquiry, shop-owners admit that gas cylinders are easily available to them for Rs 500 per cylinder, which is cheaper than commercial gas cylinders.
When contacted, officials of the civil supplies and consumer protection department claimed that they conduct inspection every month. “So far, we have conducted more than 40 raids and seized over 3,600 cylinders from shops in the city in the past three years,” said the officials.

Chennai:More than 10,000 people in the city opted for Rule 49(O), which allows the voter to mark his presence at the polling booth, but not cast his vote for any candidate. However, in many cases election officers were caught unawares.
Despite the election department’s claims of having conducted training for polling officers, many of them had no clue about the option. A few officials who knew that it existed, however, were not familiar with the right procedure to be followed. Corporation commissioner and district electoral officer Rajesh Lakhoni admitted that the turnout was unexpectedly big.
V Gopalakrishnan, a social activist, was the first at the MGR Corporation School in Chennai South constituency to ask for the Rule 49 (O) option. “The polling officer at booth 136 was totally blank. Then he asked me to ‘vote for some candidate and leave’. When I insisted on entering my refusal to vote in the 17A register, he called the zonal officer, who was equally ignorant. Finally, I called the district electoral officer and, after 90 minutes of struggle, got it done,” said Gopalakrishnan.
Dr S Murugasundaram, a dermatologist and a voter of ward 70 of Kilpauk in Chennai Central, had a similar experience when he went to vote at 8am. “The officer was rude when told about 49(O). He asked me not to create a ruckus and leave the place. However, I stood my ground and registered my refusal to vote,” he said.
Several people complained of policemen threatening them when they refused to leave the polling booths without registering their names under Rule 49(O) to prevent bogus voting in their names.
V Anandarajan of Nanganallur, which falls under the Sriperumbudur constituency, found the exercise smoother, but the officer there refused to apply indelible ink on his finger though the rule specifies that ink should be marked on the voter’s finger. All this, despite posters in front of polling booths mentioning the rule and the procedure being explained in the polling officer’s handbook (page 39).
According to Gopalakrishnan, what compounded the confusion was the use of the Tamil word ‘padivam’ (form) to describe 17A instead of ‘padivedu’ (register) under rule 49(O). Voters insisted on a form, while all they had to do was to sign in the register which others did, too, and mention in the remarks column ‘refuse to vote’.
Admitting there was widespread confusion, corporation commissioner and district electoral officer Rajesh Lakhoni said an unexpectedly large number of people opted for rule 49 (O). “Some officials may not have taken the training seriously and nobody anticipated such a large number of people choosing the option,” he said.
In Sriperumbudur constituency, residents affected by the expansion of Chennai airport had pledged to exercise the ‘no vote’ option to express displeasure at the indifference shown by political parties to their plight. But only 60 exercised it at different polling booths in Manapakkam, Gerugambakkam, Kolapakkam, Kovur and Tarapakkam in the constituency. The rest of them chose to boycott the polls, frightened of being harassed by agents of political parties.
Brinda Brighton, an office bearer of the United Peoples’ Forum for Survival, formed by affected residents, said: “People are now afraid of local agents of political parties. There is no privacy in exercising the ‘no vote’ option because we have to ask the presiding officer for form 17A and we are identified by party agents. At least in the next polls, the Election Commission should make it possible for people to exercise the option on the EVMs.”

By Our Correspondent Vellore, May 2: A number of RTI activists have turned tech-savvy by adopting high-end gadgets to exposae malpractices and corruption in the public and private sectors.
Nearly 20 to 30 activists in Chennai, Tiruvannamalai and Vellore districts have been using gadgets such as spy cam (pen and button type with 4 GB storage capacity), spy cam (antenna model) annexed in laptops, micro voice recorders, mobile camera and mobile video recorders.
“I have been using pen-type spy camera. I can record continuously for one-and-a-half hours as the tiny device comes with a rechargeable battery with 4 GB storage facility,” said Mr V. Gopalakrishnan, an RTI activist, who exposed corruption in implementing welfare schemes in Vellore taluk office using the device.

Nearly 20 to 30 activists in Chennai, Tiruvannamalai and Vellore districts have been using gadgets such as spy cam (pen and button type with 4 GB storage capacity), spy cam (antenna model) annexed in laptops, micro voice recorders, mobile camera and mobile video recorders.
“I have been using pen-type spy camera. I can record continuously for one-and-a-half hours as the tiny device comes with a rechargeable battery with 4 GB storage facility,” said Mr V. Gopalakrishnan, an RTI activist, who exposed corruption in implementing welfare schemes in Vellore taluk office using the device.

in a trickle and later in a rush and allegedly from a faulty pipeline, has been flowing into the MGR Nagar canal near KK Nagar. And, residents allege, the Chennai Metrowater Supply and Sewerage Board (CMWSSB) or Metrowater has done nothing.
The canal, a carrier of flood water, has been providing relief to areas like MGR Nagar, Nesapakkam and K K Nagar for decades. "It appears that a Metrowater pipeline, which takes untreated sewage from the pumping station in nearby Bharathidasan Colony to the one in MGR Nagar and which runs close to the canal, is faulty. Sewage from this is damaging the entire water network," C Kandavelu, a resident, told TOI. Compounding the problem, a corporation public toilet abutting the canal lets out waste into the canal, reportedly because it does not have a proper disposal system.
About 0.6 million litres of sewage, according to official records, flows through the pipeline a day. Now, an entire canal is under threat. The Adyar river flows close to the canal. "If the government agencies themselves become offenders, to whom will the public complain?" says Neela of Bharathidasan Main Road.
On Wednesday, social activist V Gopalakrishnan had a chance to check the pumping station after he shot off an RTI application seeking details about the reported lapses. But the officials, he said, failed to provide even a route map of the pipelines going out of the pumping station. "We suspect some foul play. Why else will they hide the facts? If the pipelines are close to the canal, there is every possibility of sewage flowing in," Gopalakrishnan adds.
Also, heavy vegetation and mounds of garbage in the canal block the free flow of sewage, leading to high larval density. Residents have been forced to use various repellants as protection from mosquitoes. "No contestant for the upcoming elections has expressed concern about the state of the MGR Nagar canal. It is high time the authorities concerned woke up and acted," said M Leeladevi of Pammal Nallathambi Street, MGR Nagar.
The CMWSSB's Saidapet zone officials, on the other hand, denied any such let-out of sewage. "There is a possibility of sewage flowing out if a pipeline bursts but that hasn't happened," a senior official said. He added that a person had been deployed to look into the issue.

Chennai: T Sadagopan, a consumer activist in Pattabiram, was surprised to see his appeal under the Right To Information Act returned four months after he sent it to the Central Information Commission (CIC). The CIC sent him a four-page communication explaining how to file an appeal.
Stating that his appeal was not in accordance with the procedure prescribed, the CIC put a condition that the appellant, before sending an appeal to the commission, should give a copy to the public information officer of the department about which he had sought information and a copy to the head of that department, who is the first appellate authority, An acknowledgement of this should be enclosed with the appeal to the CIC.
The commission insisted that the appeal should also have documentary proof for the fee paid along with the original application. It should also contain two sets of copies of all the documents to get the appeal admitted for hearing, it said.
Sadagopan is not alone. The long process of filing an appeal has irked the community of RTI activists with many saying it is against the spirit of the RTI Act itself.
“The CIC has gradually introduced several unreasonable and unnecessary procedures as if it is a court where we cannot file a petition without an advocate. The commission just returned one of my appeals saying it should contain five sets of copies of the documents enclosed. I avoided filing three or four appeals with the CIC merely because of the cumbersome procedure. But it is not so in the case of the State Information Commission,’’ said V Gopalakrishnan, a social worker in K K Nagar.
“While the RTI Act encourages the filing of applications by not prescribing any specified format for it but stipulating that public information officers should help applicants write the application if they are illiterates or physically challenged persons, the CIC’s unwanted procedures discourages people from filing appeals,’’ said M Nizamudeen, general secretary of Consumer Confederation of India.
CIC chief commissioner Wajahat Habibullah admitted there were some proceedural difficulties and said many of them were being removed. “The appellants need not send a copy of the appeal to the PIO or the first appeallate authority now. We have also introduced online filing of appeals. The documents can be sent to us through e-mail,’’ he said.

A RTI petitionto seek information about distribution of financial assistance under various welfare schemes like old and widow pensions to the beneficiaries in Vellore taluk limit has invited goons for the help of revenue officials to hush up the petitioner.
Having come to know about malpractices in implementing welfare schemes in Vellore taluk office, an RTI activist and resident of Chennai, V. Gopalakrishnan, petitioned the public information officer (PIO) of Vellore tahsildar office seeking details about the list of beneficiaries of the welfare schemes. The petition was filed on February 11 this year.
The petitioner urged that he be furnished a photocopy of the application, enquiry records, reports of village administration officer (VAO) and revenue inspector (RI), office note and sanction order in respect of the beneficiaries of various welfare schemes from October 2008 to January 2009.
This includes pensions to physical handicapped, OAPs and widows.
When he sent the reply to Gopalakrishnan asking him to remit Rs 21,608 to get the details, tashildar S. Thangavelu may have violated the RTIO Act as he was not the PIO or authenticating official to reply to the RTI petition. Following the letter on March 12, two persons claiming to be real estate dealers allegedly came to the petitioner’s house and working place in Chennai.
They informed Gopalakrishnan that they were sent by Vaniyambadi tashildar Sharmila Jayakumar, who was then SSS tashildar in Vellore during the period for which the petitioner sought the information.
They threatened him of dire consequence, if he did not withdraw the RTI petition.
“The two had also been to my house when I was not there. Telling me that Sharmila Jayakumar has sent them, the two said we could arrive at an amicable solution. I have video proof of the threat,” said the petitioner, adding that he immediately mailed the chief minister’s cell, chief information commissioner of Tamil Nadu information commission and district collector on the incident seeking protection for him and his family.
Meantime, an application was filed under RTI Act by his cousin Laxmanan urging the district administration to furnish the details about the properties of Tashildar Sharmila Jayakumar on February 9. But no reply has been provided till date, he said. District collector C.Rajendran said, “I will enquire into the matter and take appropriate action against errant officials.”

‘Arbitrary exemptions’ to RTI February 2nd, 2009 By Our Corresponden
Feb.1: The exemption of as many as 33 agencies in the home and public departments from the purview of the Right to Information Act in Tamil Nadu defeats the very objective of the law enacted to promote transparency and accountability of public authority, say RTI activists.
Founder of the anti-corruption awareness movement, M. Sivaraj said the exemption of the home and public department, civil supplies CID and directorate of vigilance and anti-corruption was arbitrary.
“Even the Centre had not totally exempted the Home and Public departments including the files related to the transfers and promotion of IAS and IPS officers. But the Tamil Nadu government is the only government which is making injurious exemption to the RTI Act,” he said. The DVAC and state vigilance commission dealt with corruption cases involving government officials and the exemption would benefit corrupt officials, he said.
“As per section 8 (H) of the RTI Act, disclosure of information which would impede the process of investigation or apprehension and prosecution of offenders is exempted. There is no point in exempting DVAC and SVC from the act completely,” he said adding that every investigation department has an administrative wing, which should not be exempted from the act. V. Gopalakrishnan of Fifth Pillar said the Centre had exempted only 18 intelligence and security organisations from the RTI Act.
“The state should reconsider the exemption given to so many agencies from the RTI Act,” he said.
