Grievance Description:From 18-02-2013 V. Gopalakrishnan 13/7, Pammal Nalla Thambi Street, m.G.R.Nagar, Chennai-78. To THE PRESIDENT OF INDIA, Rashtrapathy Bhavan, New Delhi-110 004. Sir, Sub: Tamilnadu RTI (fees) rules-2005, -mode of payment of further fee towards cost of information –incorporation of Indian postal order, court fee stamp, revenue stamp pay order, Non Judicial paper and electronically enabled medium in TN state authority - reg. ------ For the payment of further fee for obtaining the information, presently cash/D.D/ remittance in a particular A/c number are permitted. This is causing much difficulty in making the above payment by the applicants. Most of the PIOs in Tamilnadu are not in the authority to receive cash in their office. Hence the applicants are pillar to post making the payment at some other designated place, where they demand for some sort of authorization to receive the amount. Obtaining a D.D is costly affair, besides the officials at the Bank are reluctant to prepare the D.D because of the lengthy A/c head which is hard to be accommodated in the available space (enclosed copy). To overcome these avoidable difficulties experienced by all concerned, we propose to bring in an amendment in the rules, incorporating the postal order, court fee stamp, revenue stamp pay order, Non Judicial paper and electronically enabled medium also towards application fee as well as for the further fee, as the postal order available in all the post offices in rural areas also and the same is very easy for handling purpose. Here with I enclosed the Gazette copies for your kind perusal. In some state like Gujarat, West Bengal and Bihar state governments accepting Indian postal order, court fee stamp, pay order, Non Judicial paper and electronically enabled medium, even accepting Revenue stamp for RTI application fee, further fee for RTI, Central govt also accepting postal order. Kindly may be pleased to direct the Governor of Tamilnadu to bring in an amendment in the Tamilnadu RTI (fees) rules-2005, like above mentioned states. V. Gopalakrishnan

Grievance Description:VIOLATING THE HIGH COURT JUDGES (SALARIES AND CONDITIONS OF SERVICE) ACT 1954, AND RULES. cHIEF JUDGE AND MOST JUDGES OF CHENNAI HIGH COURT ARE VIOLATING THE ABOVE ACT AND RULES FOR THE FOLLOWING. 1. made re-imbursement on charges on account of power more than 10,000/- units per annum by the Pay and account office, high court, chennai. 2. Payment made for charges on account of power more than 10,000/- units per annum by the Pay and account office, high court, chennai to official residence of judges in Greensways road, chennai. 3.Payment made for charges on account of water more than 3600 kilolitres per annum by the Public work department chennai to official residence of former chief judges shri Y.Iqbalin Greensways road, chennai. 4.salary Payment made for the account of Maazodor 3 persons by the Public work department, chennai to official residence of judges in Greensways road, chennai there was no provision in above said act and rules to provide free maazodor to chief judges and other judges. 5. supplying more free furnishing items beyond 1,50,000 to rent free offical residence of chief justices and judges and not collecting rent for free furnishing items supplied beyond Rs.1,50,000/- by Public work department. 6. The perquisites value like rent free residence, free furnishing items , Tv, refrigerator, washing machine, Ac,Greyasor, free mazadorar,free Gardener, free water , free current are NOT added under section 17(2) of income tax act. i having documents evidence received under Right to information from Various department like Public work department, pay and Accounts office. Please take necessary to quash some government order issued by the tamilnadu government which are against the THE HIGH COURT JUDGES (SALARIES AND CONDITIONS OF SERVICE) ACT 1954, AND RULES. Please collect amount from individual judges (a)for payment like mazadorar , gardener, excess free furnishing items, etc., (b) excess payment made for current and water. Grievance Description :Sir, Sub:- RTI Act 2005- denial by way of wrong reply- disciplinary action against the PIO/High Court of madras- exemplary compensation to the appellant- reg. Ref:- 1. RTI application dt. 19-3-2012 2. Tamilnadu state information commission Case No. 37497/FB/12 The PIO , High court of madras as well as the appellate authority have acted in a manner to conceal the dissemination of the information, holding it is exempted u/s. 8(1)(j) of the Act. The factual condition is that the Public Authority is not having the information as the form 16 is not prepared by it. The PIO should have forwarded the application u/s. 6(3), where the form 16 is available. A mere perusal of the reply given by the PIO clearly goes to corroborate that he has committed abetting to hide the information from dissemination. By his above dishonest and despicable performance, the PIO has disclosed himself incapable and incompetent to hold the post. Apart from the above he displayed himself not capable enough to understand what was asked for in the RTI application. In such a case he fully deserves to be proceeded against for his dereliction of duty and for his incapacity to hold the position, by way of framing grave charges for dismissal from service. If the above contention is considered as not correct and misfit, then the only indomitable conclusion that survives is that the PIO has committed the following lapses and irregularities: a. He pretends incapable to understand, which amounts to cheating the applicant. b. By his reply, he has ridiculed, insulted and practised teasing of the applicant. c. Above all, he has made mockery of the RTI Act, besides functioning in a manner to undermine the very existence of the Act. By his above mentioned malafide attitudes, the applicant was made to suffer mental agony and irreparable loss of status in the society and caused shame to the applicant. Though the extent of damage caused could not be measured exactly, a soothing compensation roughly valued at Rs. 10 lakhs may be ordered u/s. 19 (8) (b), which may in effect exemplary and thus render justice. Grievance Description :sir, The Supreme Court has passed a decision as on 13th of September, 2012 in WP(C) 210 of 2012, Namit Sharma v/s. Union of India. If the order directions given by the Honorable Judges in the said Supreme Court Judgment were to be implemented, then, Senior Retired High Court Supreme Court Judges, post-retirement, in their new role as Information Commissioners, would be working for Quasi-Judicial Courts which is below the rank of Judicial Courts, and as such their decisions would be subject to the scrutiny appellate review of the Sitting Judges of Judicial Courts, which will result into violation of the provisions of Article 124(7) Article 220 of the Constitution of India, as follows: AS PER THE CONSTITUTION OF INDIA: Article 124(7) very clearly EXPLICITLY lays down that, no person who has held office as a Judge of the Supreme Court shall plead or act in any court or before any authority within the territory of India. Likewise, Article 220 very clearly EXPLICITLY lays down that, no person who has held office as a permanent Judge of a High Court shall plead or act in any court or before any authority in India except the Supreme Court and the other High Courts. please take necessary action. and cancel the appointed rtd judges of supreme court, high court in commission, tribunal and other post in union of india.

chennai high court judges, minister, mla are not paying professional tax

chennai high court judges, minister, mla are not paying professional tax. There are not exemption from professional tax as per chennai municpal act 1919 sec 138-H (a)(b)(c). professional tax not deducted from salary for the above person. i am having copy form16 for evidence . I enclosed reply from corporation of chennai regarding exemption. sources RTI
