RTI crusader lands in trouble

Chennai: The central government’s Right to Information Act has virtually
thrown open the iron doors of bureaucracy to the common citizen. The flipside is
that activists seeking transparency can also become targets and be prevented
from seeking information through RTI.
That is how V Gopalakrishnan of MGR Nagar landed in trouble. An ardent RTI
crusader, Gopalakrishnan had shot off several applications to various government
agencies several times demanding information on the basic amenities such as
waterways, power supply, road-widening works and encroachments.
But on Monday night, a 100-strong mob gathered in front of his house and
began abusing him for sending an RTI application to the Chennai corporation to
clear encroachments. They wanted to know why Gopalakrishnan had demanded the
demolition of three temples in MGR Nagar. For Gopalakrishnan, it was a blow out
of the blue. “The crowd was not convinced by my reply that I did not file the
application. The frustrated people abused me and my family. There was total
chaos until the police arrived on the scene,†Gopalakrishnan told TOI.
The next morning, he took some of the temple authorities to the office of the
local ward (131) and was shocked to find that application had indeed been filed
by forging his signature. Worse, the application was completely written in
Tamil, while he always prefers writing in English. His initial was also not on
the application. “I immediately lodged a complaint with the MGR Nagar police
and the civic body. But what took me by surprise was the fact that the public
got to know the applicant’s name. In fact, the Saidapet zone are not coming
out with a proper reply,†Gopalakrishnan said.
His query on the de-silting programme in the MGR canal and on the
encroachments on the canal bed, is yet to get a reply from corporation officials
since August last year. Gopalakrishnan is the secretary of the Chennai chapter
of Fifth Pillar, an NGO working against corruption in the administration.

synopsis of Hyundai Motors India, Chennaiju
M/s. Hyundai Motors India Ltd. (HMIL), Sriperumbudur, Tamil Nadu is a one hundred percent subsidiary of M/s. Hyundai Motor Corporation, Korea (HMC). M/s. HMIL apart from catering to the domestic automobile market is also exporting since the year 2000, cars, and other spare parts of motor cars, such as fully assembled engines, doors, body parts etc. (as CKD exports) to its Parent and Group companies (Associates and related parties) and to their own assembling plants situated throughout the world at less than half the ‘cost of production’ of the items by mis-declaring the market value of the items in the export documents. Such ‘below cost’ exports, is assuming huge proportions of late, (since HMIL is becoming the export hub for other manufacturing plants of HMC throughout the world, and another plant has been erected by M/s. HMIL at Sriperumbudur adjacent to the existing plant mainly for exports. By exporting at less than half the cost of production to its parent and associate companies M/s. Hyundai Motor India ltd. is draining the resources of this country illegally and huge losses as detailed below are incurred by the Nation.
1. Loss in Foreign Exchange to the Tune of thousands of crores since value declared in the export documents and realized subsequently is less than half the actual value of the goods exported.
2. Loss in Corporate Tax due to reduced turnover since the profits of the Indian subsidiary is drained and taken away out of the country to its parent company illegally.
3. Accumulation of huge CENVAT credit due to purchase of large quantities of raw materials for such illegal exports and consequent utilization of accumulated credit for the domestic clearances resulting in less payment of Central Excise duty in PLA (Personal Ledger Account), which is the actual revenue received by the Govt. The company which started production during the year 98-99 picked up production during subsequent years and paid an amount of Rs.518.83 crores in PLA during the year 2000-01. Its duty payment gradually came down subsequently due to such illegal exports and during the years 2005-06; 06-07 and 07-08 (up to Nov.07) it has paid only Rs.141.21.crores; 128.51 crores; and 87.16 crores resptly. In fact they are receiving back an amount of Rs.20 crores approx. from the Govt. every month of late as refund of the unutilized CENVAT credit accumulated due to such exports, even though the production and domestic clearance of the unit has multiplied manifold.
4. The company is grossly violating the laws of the land in taking away the profits out of the country to its Parent company viz. Section 4 of the Central excise Act 1944, Section 14 of the Customs Act 1962 and provisions of FEMA. (Foreign Exchange Management Act 2000)
5. On the domestic clearances front also, several hundred crores of Central Excise duty is evaded by the Company contravening the provisions of Section 4 of the Central Excise Act 1944, and Central Excise Valuation Rules 2000. Though the company has declared to the Central Excise Department itself that the actual buyers of the cars (Customers) are the ‘Buyers’ for the purpose of ‘Transaction Value’ in respect of certain benefits. A contradictory stand is taken in their sales through ‘Dealers’ which constitutes the major portion in their sales, by declaring the ‘Dealers’ as the buyers to evade payment of duty on Dealer Commissions. Many other evidences also confirm the fact that the dealers are not buyers but only have to be treated as “related persons” as per definitions in Section 4 of the Central excise Act 1944 and Valuation Rules 2000.
6. The Attempts of the Jurisdictional Range officer of Central Excise to investigate and bring to book the erring unit after gathering all prima facie evidences was foiled by the unit in connivance with the Department’s higher Officials. He was taken to task for attempting to investigate. No proper action was taken even after the facts were brought to the knowledge of the PM; FM; and the CBEC; the matter is being hushed up by obtaining false reports from the accused person himself without proper investigations. Efforts to find out the facts through filing of applications under the RTI have also failed in revealing the circumstances under which the issue has been closed by the CBEC. Only partial information after deleting names and confidential portions have been furnished. Full information on how the issue was closed has been refused even after appealing to the CIC

CHENNAI: The average number of cases heard by the Tamil Nadu State Information Commission per commissioner per month has gone down since May, when four commissioners were added to ensure speedy disposal of cases.
An analysis of the hearings conducted by the Commission in 2008 (based on data provided by the Commission to an RTI activist) shows that the average efficiency has been reduced with only 11.7 cases heard per commissioner per month from May to December, whereas 18.4 cases were heard per commissioner per month between January and April.
Although the number of days when hearings were held has increased to an average of 12 days per month in the last seven months from 8 days per month in the first four months of the year, the increase in the number of hearings by groups of commissioners could have caused the reduction in the average per commissioner.
The analysis notes that the proportion of cases handled by a single commissioner has reduced from 82 per cent in April (79 per cent in January, 83 in February and 13 in March) to a maximum of 39 per cent in September and finally 10 per cent in December. With nearly 400 petitions received each day, the Tamil Nadu State Information Commission is heavily overloaded, according to S. Ramakrishnan, chief commissioner. Most cases are disposed of at the 'tapal' stage itself and only a few scheduled for hearing by commissioners and this takes up quite a bit of the commission's time.
He says in the first few months, the newly inducted commissioners mostly sat in groups to help in a uniform process of trial and to make sure judgments were standardised across commissioners. Soon more individual sittings could be conducted as all commissioners were on the same page, he says. However, to increase efficiency, Mr. Ramakrishnan says that the Commission will hold more hearings in districts.
He argues it will not be possible to hold more than 10 or so hearings each day at the Commission itself. Instead, commissioners will tour different districts and dispose of cases there itself saving time and money.
But another activist in Chennai says the system itself needs to be changed to increase efficiency. "It takes quite a long time for cases to be heard and disposed of. But the bigger problem is that there is no enforcement mechanism. If I don't get the information that the Commission says I should get, there is no recourse but to file another petition and go through the lengthy process one more time."

Respected Madam, I am residing in M.G.R.Nagar near K.K.Nagar, chennai-78. i use to get the information under right To information Act. on 16th april around 9.40 p.m local counsillor ( Mr. venkatesan) accompained with six member came to my house threathen me and told if you write any letter under right to information act your life will be closed. while talking itself more than three person tried to attack me but public gathered and saved me,and asked why are you came here. what is wrong asking information. in mean time i made complaint to police 100 more than three times. after third call only only one police constable came he is also crime branch department, and he told i send the law and order police. i again made complaint to 100 , then the two police officiers came they kept silent because of the counsillor standing. I again made complaint to 100 at last the police patrol came ( the time of first and last call more than one hour). i was escaped and life was saved because of public. Next day (17/4/2008) around 11.15a.m i made a complaint to the R-10, M.G.R.nagar, Chennai-78. I came to heard through IS that my CSR is ready and in hands of inspector. R-10 police station No. 23452560,23452561 inspector(Mr. Rajasekar) )mobile no. 9840302232
